PRIVACY NOTICE ON THE PROCESSING OF PERSONAL DATA VIA THE CONTACT FORM

1. Data Controller

As TURENO Enerji İnşaat Limited Şirketi (“TURENO” or the “Company”), we process the personal data submitted to us through the contact form on our website at tureno.com.tr in accordance with Law No. 6698 on the Protection of Personal Data (“KVKK”) and the related legislation.

This Privacy Notice has been prepared, pursuant to Article 10 of the KVKK and the Communiqué on the Principles and Procedures to Be Followed in Fulfilling the Obligation to Inform, to inform data subjects about the processing of personal data obtained through the contact form.

2. Personal Data Processed

When the contact form on our website is completed and submitted to our Company, the following personal data that you share through the form may be processed:

Identity Information: First name and surname.

Contact Information: E-mail address and, if provided, telephone number.

Corporate Information: If provided, company or organization name and corporate information that can be associated with a natural person.

Request and Communication Information: The service area of interest, the content of the message, and the information contained in correspondence conducted in the course of evaluating the request.

Our Company does not intend to collect special categories of personal data through the contact form. Accordingly, special categories of personal data that are not necessary for the evaluation of your request, and personal information belonging to third parties, should not be shared in the message field.

3. Purposes of and Legal Grounds for Processing Personal Data

Your personal data obtained through the contact form is processed for the purposes stated below, on the legal grounds indicated for each.

3.1. Managing Communication and Information Requests

Your personal data is processed for the purposes of receiving, evaluating and responding to the questions, comments and requests for information submitted through the contact form, and of contacting you in line with your request.

This processing is carried out under Article 5/2-f of the KVKK, on the legal ground that processing is necessary for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

3.2. Evaluating Service Requests and Conducting Proposal Processes

Your personal data is processed for the purposes of evaluating your requests relating to energy efficiency, solar energy systems, and technical measurement and analysis services, determining the scope of the service requested, preparing a proposal, sending the proposal to you and conducting negotiations with a view to concluding a contract.

This processing is carried out under Article 5/2-c of the KVKK where it is directly related to the conclusion or performance of a contract and the processing of personal data belonging to the parties to the contract is necessary.

For the evaluation of corporate applications made by persons who are not party to the contract, and for communication with the person concerned, the legal ground of legitimate interest under Article 5/2-f of the KVKK may be applied, provided that the processing is necessary and proportionate.

3.3. Protecting Legal Rights

Where there is an actual legal dispute, or where it is necessary for the protection of a right, records relating to communication and service requests may be processed for the purposes of evaluating the requests concerned, exercising legal rights and serving as evidence in potential disputes.

This processing is carried out under Article 5/2-e of the KVKK, on the legal ground that data processing is necessary for the establishment, exercise or protection of a right.

Your personal data is processed in a manner that is limited and proportionate to the stated purposes, and is not otherwise used for advertising, campaigns, marketing or unsolicited commercial promotion.

4. Method of Collecting Personal Data

Your personal data is obtained electronically, by automated or partly automated means, when you complete and submit the contact form on our website at tureno.com.tr and through the ongoing communication relating to your request.

The information sent through the form is delivered to our Company's corporate e-mail address and is processed by authorized persons for the purpose of evaluating the request concerned.

5. Transfer of Personal Data

Your personal data obtained through the contact form is used by our Company's personnel who are assigned and authorized to evaluate the request concerned, limited to the purposes of processing.

Your personal data may be shared with the IT and infrastructure service providers from which services are obtained for the technical provision of the website and corporate e-mail services, to the extent required by the service and in accordance with the conditions of Article 8 of the KVKK.

In addition, where necessary to respond to duly made requests from authorized public institutions and organizations under the applicable legislation, or to fulfil legal obligations, your personal data may be transferred to the competent authorities.

6. Retention and Destruction of Personal Data

Your personal data obtained through the contact form is retained for as long as the purposes of processing require, taking into account the nature of the request and the obligations arising from the applicable legislation.

When the legal grounds requiring the retention of the data cease to exist, the personal data is erased, destroyed or anonymized in accordance with Article 7 of the KVKK and the related legislation.

7. Rights of the Data Subject under the KVKK

Pursuant to Article 11 of the KVKK, by applying to our Company you have the following rights in relation to your personal data:

a) to learn whether your personal data is being processed;

b) to request information about the processing if your personal data has been processed;

c) to learn the purpose of the processing of your personal data and whether it is being used in accordance with that purpose;

d) to know the third parties, in Türkiye or abroad, to whom your personal data is transferred;

e) to request the rectification of your personal data if it has been processed incompletely or inaccurately;

f) to request the erasure or destruction of your personal data under the conditions set out in Article 7 of the KVKK;

g) to request that the above rectification, erasure or destruction be notified to the third parties to whom your personal data has been transferred;

h) to object to any result to your detriment that arises from the analysis of your processed data exclusively by automated systems;

i) to claim compensation for any damage you suffer as a result of the unlawful processing of your personal data.

8. Application Procedure

You may submit applications concerning the rights you hold under Article 11 of the KVKK to our Company in accordance with Article 13 of the Law and the Communiqué on the Principles and Procedures for Application to the Data Controller.

You may submit your applications:

• in writing, to our Company's address stated above;
• by registered electronic mail (KEP), secure electronic signature or mobile signature, in the manner laid down in the applicable legislation;
• to info@tureno.com.tr, using the e-mail address that you have previously notified to our Company and that is registered in our system.

Your applications will be evaluated and concluded as soon as possible depending on the nature of your request, and in any event within thirty days at the latest of reaching our Company.
